Rental Terms and Conditions for the Cardihaler
These Rental Terms and Conditions apply between Arktis BioPharma Schweiz AG, Steig 3, 8840 Einsiedeln SZ (hereinafter referred to as the “Lessor”) and the Lessee as soon as the Lessee proceeds with the order process for the Cardihaler.
1. Rental Item
The Lessor leases the following device to the Lessee:
The Cardihaler remains the property of the Lessor at all times.
2. Rental Period
The rental period is determined by the rental option selected during the ordering process and the start date specified therein. Any extension of the rental period requires the Lessor’s written consent.
3. Rental Fee
The rental fee is based on the selected rental option and must be paid in advance as part of the ordering process. The rental item will not be handed over unless payment is received by the due date.
4. Services Not Included
The required carbon dioxide (CO₂) is not included in the rental. The renter agrees to procure BIOGON E290 gas (food-grade) or the blue CO₂ cylinders from SodaStream at their own expense. Upon request, the lessor will provide the lessee with information on where and in what form the CO₂ is available.
5. Use of the Cardihaler
The Cardihaler may be used exclusively for private, therapeutic purposes. The renter agrees to handle the device with care and to use it only in accordance with the operating instructions. Any subletting or transfer to third parties is prohibited without the lessor’s consent. The lessor assumes no liability for medical effects.
6. Liability
The renter is liable for all damage resulting from improper use or negligence. Normal signs of wear and tear are not considered damage. The lessor is not liable for any health-related harm resulting from improper or unauthorized use. The renter agrees to notify the lessor immediately of any defects or malfunctions that occur.
7. Return
The Cardihaler must be returned at the end of the rental period in its entirety, cleaned, and in perfect condition. The renter will be billed for any missing parts or damage.
8. Insurance
The renter agrees to notify the lessor immediately in the event of theft or loss of the Cardihaler and to compensate the lessor for any resulting damage.
9. Final Provisions
Any changes or additions to these rental terms and conditions must be made in writing. Should any individual provisions be invalid, the remaining provisions shall remain valid. The place of jurisdiction is Einsiedeln, SZ.
