General Rental Terms and Conditions
These General Rental Terms and Conditions govern the rental of all rental products from Gruber CO₂ Systems, a brand of Arktis BioPharma Schweiz AG.
They apply in addition to the respective product descriptions, the individual rental agreement, and the handover report.
By entering into a rental agreement, the renter accepts these General Rental Terms and Conditions.

2. Subject Matter of the Lease
The subject matter of this rental agreement is the rental products offered by Gruber CO₂ Systems, specifically:
All rental products remain the exclusive property of Gruber CO₂ Systems throughout the entire rental period.
The lessee is granted only the right to use the rental product for its intended purpose during the agreed rental period.
Subletting, pledging as collateral, or transferring the product to third parties is not permitted without the prior written consent of Gruber CO₂ Systems.
3. Scope of Delivery

The renter agrees to return all listed components in full.
Missing or damaged accessories may be billed at the current replacement price.
4. Conclusion of the Contract
The rental agreement is concluded as soon as Gruber CO₂ Systems confirms the order and the full rental fee has been received.
A right to delivery arises only after full payment has been received.
5. Rental Period
The rental period is specified in the respective order or rental agreement.
An extension of the rental period is generally possible.
This requires the consent of Gruber CO₂ Systems and should, if possible, be agreed upon before the original rental period expires.
6. Rental Price
No security deposit is required.
The agreed-upon rental price must be paid in full in advance.
Shipping will not take place until full payment has been received.
All current rental rates are listed in the currently valid price list in the online store.
7. Delivery
Delivery is made in accordance with the current shipping terms of Gruber CO₂ Systems.
Delivery dates are approximate.
8. Use of the Rental Product

9. Products with Special Hygiene Requirements
Some components of our rental products are subject to special hygiene requirements due to their direct contact with the body.
These include, in particular:
For hygienic reasons, products that have already been worn or used and that are subject to special hygiene requirements cannot be exchanged or returned.
The Cardisuit suit must be cleaned in accordance with the care instructions provided by Gruber CO₂ Systems.
10. Rental with Option to Purchase
Gruber CO₂ Systems offers a purchase option for select rental products.
If the renter decides to purchase the rental product during or after the rental period, a portion of the rent already paid may be credited toward the purchase price.
The applicable credit models are set forth in the current price list or the respective product description.
11. Return
At the end of the rental period, the rental product must be returned complete, cleaned, and in proper condition.
Return shipping is at the renter’s expense, unless otherwise agreed.
Before shipping the item back, the device must be securely packaged for transport.
12. Late Return
If the rental equipment is not returned by the due date and no extension has been agreed upon, Gruber CO₂ Systems is entitled to charge the applicable rental rate for the following month that has already begun.
The right to claim further damages is reserved.
13. Damage and Loss
Normal signs of wear and tear are not considered damage.
The renter is liable for damage resulting from improper use, negligence, or intentional damage.
In the event of loss or theft of the rental product, Gruber CO₂ Systems must be notified immediately.
Missing parts and irreparable damage may be billed to the renter at replacement cost.
14. Warranty
Should a technical defect occur during the rental period that was not caused by improper use, the renter must notify Gruber CO₂ Systems immediately.
After an inspection, a suitable solution will be sought jointly.
15. Medical Notice
The rental products from Gruber CO₂ Systems are not intended for the diagnosis, treatment, or cure of diseases.
They are not a substitute for consultation with or treatment by a physician or other qualified medical professional.

16. Data Protection
The Gruber CO₂ Systems Privacy Policy, in its currently valid version, applies to all data processing.
17. Changes
Gruber CO₂ Systems reserves the right to amend these General Rental Terms and Conditions at any time.
The version valid at the time the contract is concluded shall apply.
18. Governing Law and Jurisdiction
Swiss law shall apply exclusively.
The place of jurisdiction is, to the extent permitted by law, Einsiedeln (Canton of Schwyz), Switzerland.
